1. Current Canary Statement
To the best of TierFive’s knowledge, following a reasonable internal review of records and information available to authorized management as of the Current Status Date, during the Period Covered above:
- TierFive has not received a National Security Letter accompanied by a nondisclosure requirement that prohibits TierFive from notifying an affected customer or publicly acknowledging receipt of the demand.
- TierFive has not received an order, directive, or demand issued under the Foreign Intelligence Surveillance Act that requires TierFive to provide customer content, customer account information, communications, or technical assistance in secret.
- TierFive has not received any other classified or secret governmental demand requiring undisclosed bulk, indiscriminate, or ongoing access to customer content, customer accounts, hosted files, communications, systems, or services.
- TierFive has not been ordered or required to create or install a government-access backdoor, intentionally weaken encryption or security controls, introduce undisclosed surveillance functionality, or provide government access that bypasses TierFive’s ordinary authentication and authorization controls.
- TierFive has not been ordered or required to disclose customer-controlled passwords, encryption keys, or credentials that are not otherwise available to TierFive in an accessible form.
- TierFive has not been prohibited by a classified or secret governmental demand from publishing this Notice in its current form.
TierFive will not knowingly publish or renew this Notice if an affirmative statement above is no longer accurate as of the applicable review date.
2. What This Notice Does Not Say
This Notice does not state or imply that TierFive has received no subpoenas, search warrants, court orders, preservation requests, civil discovery requests, regulatory demands, customer-authorized requests, emergency requests, or other ordinary legal process. TierFive may receive and respond to lawful requests in accordance with applicable law, its customer agreements, and its
Legal Process, Government Requests, and Customer Information Policy. This Notice also does not guarantee that TierFive will be legally permitted to notify a customer or publicly describe every request. Applicable law or a valid court order may restrict or delay disclosure.
3. Review and Renewal
TierFive intends to conduct an affirmative review of this Notice at least once each calendar quarter. Each renewal should be based on a reasonable review of records and information available to authorized management and, where appropriate, consultation with legal counsel. A renewal is effective only when TierFive updates the Current Status Date, Period Covered, Last Affirmative Review date, and Next Scheduled Review date after completing that review. Merely republishing, migrating, caching, restoring, or technically modifying this webpage does not constitute an affirmative renewal of the Canary Statement.
4. Expiration, Removal, or Modification
Expiration Rule:
If TierFive does not affirmatively renew this Notice within 30 calendar days after the Next Scheduled Review date, the Notice should be treated as expired and TierFive should no longer be understood as affirmatively making the Current Canary Statement. Removal, expiration, delayed renewal, or material modification of this Notice does not, by itself, confirm that TierFive received any particular demand, order, directive, classified process, or nondisclosure requirement. A change may result from legal advice, changes in law, uncertainty about a statement, administrative delay, personnel availability, website maintenance, a security incident, a business decision, an inability to complete the required review, or another circumstance unrelated to government process. TierFive may revise, suspend, discontinue, or replace this Notice whenever it determines that doing so is legally required, factually necessary, operationally appropriate, or in the best interests of TierFive and its customers.
5. Customer Privacy and Government Requests
TierFive considers customer privacy and confidentiality a fundamental responsibility. TierFive does not disclose customer information unless authorized by the customer, required by valid and enforceable legal process, or otherwise permitted by applicable law. Where legally permitted and appropriate, TierFive may:
- Notify the affected customer.
- Provide a reasonable opportunity to seek protective relief.
- Authenticate, challenge, object to, or seek narrowing of a request.
- Limit disclosure to information responsive to valid legal process.
- Redact unrelated, privileged, confidential, regulated, proprietary, or security-sensitive information.
- Require secure transmission, handling, confidentiality protections, or an appropriate protective order.
- Seek reimbursement of reasonable response costs.
- Require foreign requests to proceed through a mechanism recognized by applicable United States law.
Nothing in this Notice limits TierFive’s right to assert objections, privileges, confidentiality protections, contractual rights, privacy rights, security requirements, or other defenses and remedies.
6. Interpretation and Legal Limitations
This Notice is a voluntary, dated transparency statement. It is not a contract, warranty, service-level commitment, representation concerning future events, or promise that TierFive will always be permitted to publish, modify, remove, or decline to renew a warrant canary. Certain laws permit governmental demands to be accompanied by nondisclosure requirements, and the recipient may have statutory procedures for seeking judicial review. The legal effectiveness of a warrant canary as a method of communicating about such process is not definitively established. Nothing in this Notice should be interpreted as an agreement to violate applicable law, disobey a court order, interfere with an investigation, disclose classified information, waive a legal right, or create an inference beyond the express dated statements published here.

TierFive may maintain archived copies, publication records, approval records, cryptographic hashes, or other evidence concerning prior versions. Any public archive may be provided on this page or through a separately identified TierFive archive.
